La justice allemande vient de donner raison \u00e0 son inventeur. Jusqu\u2019au 25 d\u00e9cembre prochain.<\/p>\n<p style=\"text-align: justify;\">C\u2019est l\u2019\u00e9pilogue d\u2019une \u00e9tonnante bataille judiciaire allemande qui a appos\u00e9 Mercedes \u00e0 Ludwig Schatzinger. Ce dernier reprochait au constructeur \u00e0 l\u2019\u00e9toile l\u2019exploitation d\u2019un de ses brevets au coeur du syst\u00e8me Airscarf, le chauffage de la nuque situ\u00e9 dans l\u2019appui-t\u00eate de tous les cabriolets Mercedes, de s\u00e9rie ou en option, depuis 2004. <\/p>\n<h2>Une mesure qui ne concerne que l\u2019Allemagne<\/h2>\n<p style=\"text-align: justify;\">La justice allemande a ainsi tranch\u00e9 en faveur de Ludwig Schatzinger et interdit \u00e0 Mercedes toute publicit\u00e9 pour son syst\u00e8me Airscarf, d\u2019en faire mention et doit \u00e9galement le retirer (ou le d\u00e9sactiver) de tous ses mod\u00e8les en Allemagne, sous peine d\u2019amendes. Les v\u00e9hicules d\u00e9j\u00e0 vendus ne sont pas concern\u00e9s, mais \u00e0 charge de Mercedes d\u2019appliquer la mesure en cas de reprise. Le constructeur allemand devra \u00e9galement verser des indemnit\u00e9s \u00e0 l\u2019inventeur (une indemnit\u00e9 par mod\u00e8le vendu qui reste \u00e0 pr\u00e9ciser). Pour autant, cette mesure ne concerne que l\u2019Allemagne et prendra fin\u2026 le 25 d\u00e9cembre prochain, date de fin de la protection du brevet d\u00e9pos\u00e9 en 1996. Une d\u00e9cision qui peut para\u00eetre \u00e9tonnante, mais il faut tenir compte de la longueur de la proc\u00e9dure.
